Terms of Service

These Terms govern your use of talktobuild.tech, operated by Yash Goyal, an individual based in India. The service lets you work with Lumi to explore app ideas, generate artifacts, schedule calls, use a collaborative whiteboard, and prepare build handoff materials.

1. Acceptance

By creating an account, clicking to accept these Terms, accessing the service, or continuing to use the service after changes take effect, you agree to these Terms. If you do not agree, do not use talktobuild.tech.

References to "we," "us," and "our" mean Yash Goyal operating talktobuild.tech. References to "you" mean the person or entity using the service.

2. Service

talktobuild.tech is an AI-assisted product planning service. You can describe an app idea, chat or speak with Lumi, book discovery and technical calls, generate blueprints and documents, work on a collaborative whiteboard, and export handoff materials for builders or development tools.

The service is evolving and may include beta, test-mode, or experimental features. We may add, change, limit, or discontinue parts of the service at any time, subject to applicable law.

3. Eligibility And Accounts

  • You must be at least 18 years old and capable of entering into a binding contract to use the service.
  • You are responsible for your account credentials and for all activity under your account.
  • You must provide accurate account information and keep it current.
  • You may not share, sell, or transfer your account without our written permission.

4. User Content And IP

You own your ideas, project content, prompts, files you submit, whiteboard content, and all generated outputs made available to you through the service, including blueprints, planning documents, prompt packs, and handoff materials, to the maximum extent allowed by law.

You grant us a limited, worldwide, non-exclusive, royalty-free license to host, copy, process, transmit, display, modify, and create intermediate versions of your content only as needed to operate, secure, support, and improve the service, comply with law, and enforce these Terms.

You represent that you have all rights needed to submit your content and that your content does not violate law or third-party rights. We do not claim ownership over your startup idea or the outputs generated for your project.

5. AI Disclaimer

All AI-generated content, including plans, specifications, architecture advice, blueprints, documents, prompt packs, recommendations, and live-call responses, is provided "AS IS" without warranty of accuracy, completeness, reliability, security, legality, non-infringement, or fitness for any purpose.

AI output may be wrong, incomplete, outdated, biased, unsafe, or unsuitable for your use case. It is not professional, legal, financial, business, product, security, or engineering advice. You are solely responsible for reviewing, testing, validating, and deciding whether to rely on anything produced by the service.

You are solely responsible for anything you build, launch, publish, buy, hire, spend, or otherwise do based on service output. You should consult qualified professionals before making important legal, financial, technical, safety, or commercial decisions.

6. Payments And Refunds

The service may offer one-time "treat" purchases for Lumi, priced in INR. Treats are not subscriptions. They may unlock features such as pre-warming, priority access, deeper technical focus, or additional revision capacity.

Payments may be processed through Razorpay when enabled. The current gateway may operate in test mode, in which case no real charge is made. You authorize us and our payment provider to process the payment metadata needed to complete and verify your purchase.

All sales are final except where the paid feature was not delivered or a refund is required by applicable law. Taxes, fees, bank charges, currency conversion costs, and payment-provider rules may apply.

7. Acceptable Use

You must not use the service to:

  • Violate law, regulation, contract, privacy rights, or intellectual-property rights.
  • Submit illegal, abusive, hateful, harassing, exploitative, or harmful content.
  • Upload malware or attempt unauthorized access to accounts, systems, data, APIs, or infrastructure.
  • Reverse engineer, decompile, probe, scrape, crawl, benchmark, or extract the service except as allowed by law or our written permission.
  • Bypass rate limits, payment controls, access controls, security controls, or usage restrictions.
  • Misrepresent AI-generated output as professionally verified advice or as work created by a human expert.
  • Use the service to build or support weapons, surveillance abuse, scams, spam, or other harmful systems.

8. Suspension And Termination

We may suspend, limit, or terminate your account or access to any feature if we reasonably believe you violated these Terms, created risk for us or others, used the service abusively, failed to pay, or if required by law or provider restrictions.

You may stop using the service at any time and may request account deletion by contacting us. Termination does not affect provisions that by their nature should survive, including intellectual property, payment obligations, disclaimers, liability limits, indemnity, dispute terms, and general provisions.

9. Third-Party Services

The service depends on third-party providers including Supabase, OpenRouter, OpenAI, Deepgram, LiveKit, Cal.com, and Razorpay. Your use of features that rely on those providers may be subject to their terms, policies, availability, and technical limits.

We are not responsible for third-party services, outages, errors, model behavior, payment-provider decisions, calendar-provider behavior, or changes made by those providers, except where applicable law says otherwise.

10. Warranty Disclaimer

To the maximum extent permitted by law, the service and all outputs are provided "AS IS" and "AS AVAILABLE." We disclaim all express, implied, statutory, and other warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, uninterrupted operation, security, and error-free performance.

We do not warrant that the service will meet your requirements, that generated outputs will be correct or useful, or that defects will be corrected.

11. Limitation Of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, or for lost profits, lost revenue, lost savings, lost business, lost data, loss of goodwill, business interruption, or cost of substitute services, even if we were advised such damages were possible.

To the maximum extent permitted by law, our total aggregate liability for all claims relating to the service or these Terms is capped at the greater of INR 1,000 or the amount you paid us for the service in the 12 months before the event giving rise to the claim.

Some jurisdictions do not allow certain exclusions or limitations. In those cases, the limits apply to the maximum extent enforceable. Consumers keep any non-waivable statutory rights.

12. Indemnity

To the maximum extent permitted by law, you will defend, indemnify, and hold harmless Yash Goyal from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from or related to your content, your products or services, your misuse of the service, your violation of these Terms, your violation of law, or your infringement of third-party rights.

13. Governing Law And Disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Subject to any non-waivable consumer rights, disputes will be resolved by binding arbitration seated in India under the Arbitration and Conciliation Act, 1996.

Arbitration will proceed on an individual basis only. Class, collective, consolidated, representative, or private attorney general proceedings are waived to the extent enforceable. Either party may seek interim or injunctive relief from a court of competent jurisdiction where necessary to protect rights or prevent irreparable harm.

14. General Terms

  • Force majeure: we are not liable for delay or failure caused by events beyond our reasonable control, including outages, provider failures, labor issues, war, terrorism, government action, natural disasters, epidemics, or internet failures.
  • Severability: if any provision is unenforceable, the remaining provisions remain in effect and the unenforceable provision will be modified to the minimum extent needed to make it enforceable.
  • No waiver: failure to enforce a provision is not a waiver of our right to enforce it later.
  • Assignment: you may not assign these Terms without our consent. We may assign them as part of a merger, acquisition, reorganization, sale of assets, or by operation of law.
  • Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and us regarding the service.

15. Changes

We may update these Terms from time to time. We will update the "Last updated" date and, for material changes, provide reasonable notice through the service or by email. Continued use after changes take effect constitutes acceptance of the updated Terms.
